Accident at home claims

For all the risks that can be found at work or in public, people are injured at home every year than anywhere else. The Royal Society for the Prevention of Accidents (RoSPA) says that 2.7 million people every year go to A&E after an accident in the privacy of their own homes.

There are so many different causes and types of home accidents. And if you've been injured in an accident of your own, and someone else is to blame, it means you could have a claim for accident at home compensation.

At ClaimsPeople, we're here to help you get the compensation you deserve. Our panel of accident at home solicitors has a huge amount of experience supporting normal people just like you.

The types of home accidents you can claim for

Slips, trips and falls

Some of the most common accidents at home are caused by hazards on the floor. Slips, trips, and falls caused by uneven flooring, broken steps, or trailing wires can lead to serious injuries. In such cases, you could make a claim against your landlord.

Cuts and burns

You'd almost be shocked by the number of warm items and sharp objects (e.g., broken glass) that can be responsible for serious and even life-threatening cuts and burns around the home.

Choking and suffocation

For young children, small objects can be a major choke hazard. But adults can also be affected by home accidents where hazards, toxic gases, or even structural defects lead to suffocation.

Poisoning

Did you accidentally consume contaminated liquid? Were you exposed to carbon monoxide due to a faulty boiler? If so, poisoning is an example of an accident at home you can claim for.

Falling objects

Being struck by a falling object in the home can have serious consequences. It could be caused by overfilled storage, poor quality building work, or badly maintained tiles and bricks.

Drowning

It's not necessarily one of the most common types of home accidents in the UK. Any amount of standing water, however, can create a risk of drowning - especially for babies and children.

Home accident claim FAQs

Accidents at home can be bad enough. But when someone else is at fault? That's when you need someone to help you get the compensation you need. Our home accident FAQs below give you more of the information you need before you get started.

No win no fee claims explained

In a no win no fee claim, an accident at home solicitor will take on your case with nothing for you to pay upfront. Also known as a conditional fee agreement, no win no fee is a contract where you only ever pay if your claim succeeds.

The point of no win no fee is to help people make a legal claim for accident at home compensation when they otherwise couldn't do or feel concerned that it might make their financial situation worse.

Until your claim is settled, all legal costs will be covered by your solicitor under a no win no fee agreement. If you lose, there's nothing to pay - meaning it's a risk-free way to make an accident at home claim. If you win, your solicitor will take a pre-agreed  amount with you prior to moving ahead with your claim. This amount will be taken out of the compensation you win. There's nothing more to it than that.

Where do most accidents occur in the home?

An accident can happen in any part of the home or even outside in the garden. You may think the kitchen is the biggest accident hotspot. After all, it's where you prepare hot food and keep sharp objects. But RoSPA says more accidents actually happen in the living room.

The fact is that almost anything has the potential to cause home injuries. Carpets, cupboards, and cups of tea can pose a risk if not correctly fitted, looked after, or used properly.

Can I claim if I'm injured in someone else's home?

Yes - if you have an accident in a home that isn't your own and someone else is to blame, you could still make an accident at home claim. Get in touch with us on 0800 587 0344 and tell us how you were injured. We'll then be able to tell you if we think your case is likely to be successful.

How do I start an injury at home claim?

It's easy to start your injury at home claim with ClaimsPeople, with one of three options to choose from:

  • Give us a call on 0800 587 0344 and talk to one of our expert advisors for an instant verdict on your home accident claim. Our lines are open seven days a week until late.
  • Fill out the callback form on this page with your name, number and accident type. We then call you back at no charge to talk about your claim.
  • Use our free accident at home compensation calculator and get a much clearer idea of what your claim may be worth. In some cases, you could even start your claim online.

Is there a time limit to making a home accident claim?

Like all other personal injury claims, you have three years from the date of an accident at home to start your claim. It's always a good idea to get the ball rolling as soon as you can because all the details will still be fresh in your mind.

In some cases, this time limit might not apply - such as when you're applying on behalf of your child. Our advisors can let you know if this is the case for you when you get in touch with us.

How does an accident at home claim work?

We aim to make the claims process as simple as it can be. So, when you contact us, the first thing we'll do is let you know if we can support your accident at home claim. If we can, the next steps will usually be:

  • You'll be put in touch with one of our specialist accident at home solicitors.
  • Your solicitor's main aim will be to learn how much your injury is affecting you. To do this, you may be asked to provide evidence such as photos or medical records.
  • With all the details of your home accident to hand, your solicitor will contact the person (or organisation) at fault.
  • The other party then has the choice to accept fault or contest the claim. If they don't accept fault, your solicitor will enter negotiations on your behalf.
  • If your claim is a success, you'll get your compensation - with your accident at home solicitor taking a pre-agreed share. If it isn't, you won't have to pay anything.

Can I claim accident at home compensation online?

It could be possible to claim accident at home compensation online. Unlike other companies, our compensation calculator lets you know straight away what your claim may be worth. It can also tell you if you're able to continue your claim online.

How long does an injury at home claim take?

There's no set timetable for an injury at home claim. Each accident has its own unique factors that need to be considered carefully. These can include how serious your injury was and what evidence we need to collect. So, the time it takes to settle a claim varies from case to case.

What we can promise you, however, is that we'll do all we can to assess your claim as quickly as possible. You'll be told immediately if we think you have a case. And your accident at home solicitor will then take care of everything on your behalf - while always keeping you up to date.

How much accident at home compensation will I get?

Just as there's no set length of time for an accident at home claim to be settled, there's no set amount of compensation you can expect to get either. It's based on your individual situation - and the compensation you get is designed to reflect the unique impact of your home accident.

The amount factors in the extent of your injuries, your overall wellbeing, and any extra care or treatment you'll need in future. But we will use the Judicial College Guidelines (15th edition) to assess your claim and work out what we think you should get.

Your accident at home solicitor will do all they can to get the most compensation possible for your injuries. If the claim is a success, it'll be paid by the other party's insurance provider. Use our compensation calculator to get a sense of whether you have a claim and it's indicative value. Or give us a call 0800 587 0344 and we can make an assessment there and then on whether you have a claim.

If I win, how much do I have to pay?

The party at fault for your home accident could be made to contribute towards your legal costs if you win your claim. In most cases this contribution will only cover part of your legal costs and your solicitor will make a deduction from your compensation to cover costs such as insurance, legal costs and a success fee.

But don't worry - anything that needs to be paid, will be from your compensation will be up to a maximum amount that you agree at the start of your claim. This is one of the things your accident at home solicitor will cover in detail so you don't have any surprises when you win your claim.

Will I need no win no fee insurance?

It's a good idea to have 'After the Event' insurance when making any sort of personal injury claim. It covers all your legal costs - even if your claim isn't successful - so you don't have to worry about any upfront costs.

We will take care of this for you and there is nothing to pay upfront. You will only pay the premium if you win your claim, and that will be included in our overall cap on charges, so there'll be no nasty surprises once your case is settled.

Will my claim go to court?

For some, the idea of going to court can seem daunting. But the good news is that most home accident claims are settled without getting that far.

The only reason you might have to go to court is if an agreement with the other party can't be reached or they refuse to accept the blame. This is when your solicitor may need to start formal court proceedings.

If this happens with your claim, don't panic. Your accident at home solicitor will continue to look after everything. They'll guide you through all the next steps so you know what's what.

I lost my claim. What happens next?

Nothing. In the unlikely event that your claim is unsuccessful, there's nothing for you to pay or do. This is because we take almost all cases on a no win no fee basis.
