What is a no win no fee back injury claim?

No win no fee is also called a Conditional Fee Agreement. It acts as a contract between you and your back injury lawyer. More importantly, however, it means you won't pay a thing if you lose.

How does a back injury claim work?

Our aim is to make the claims process as simple as it can be for you. In most cases, this is what you can expect:

  1. You'll tell your back injury solicitor what happened and how it's affecting you. You may need to provide evidence to help your case - such as photographs, medical records or any witnesses.
  2. Your solicitor will then inform the other party that you intend to make a claim.
  3. If the other party accepts blame for what happened, your lawyer should be able to settle your case quickly. If they don't, we'll start negotiations on your behalf.
  4. If you win, you'll get your compensation. Your solicitor will also take a pre-agreed share of that figure as their payment. If you lose, however, there's nothing to pay.

If you win your case, it may be that the other person or party has to contribute towards your legal fees. Your solicitor then takes a pre-agreed amount from your total settlement to cover the rest - such as any success fee or the cost of any no win no fee insurance taken out.

It's important to remember that any amount we take from your compensation is agreed with you at the start. And this will all be made clear by your solicitor at the time. That way, you'll have no unwelcome surprises once your claim is settled.


Should I get no win no fee insurance?

No win no fee - or After the Event (ATE) - insurance is recommended when you start a back injury claim. It helps to take away the risk by covering all the legal fees involved. So, even if your claim is unsuccessful, your insurance means you won't have to pay.

This is something we can organise for you at the start. There's no premium to pay - the price is included in our overall cap on charges. And that means it'll come out of your compensation.


Do I have to go to court?
