We will let you know immediately if you could have a case for claiming compensation in our initial discussion with you. As an accident management company, we believe all the legal heavy lifting should be done for you and your legal team will stick to that principle, letting you know the progress of your claim as it progresses.
How long it takes to secure compensation depends on a number of factors, including the extent of your injuries, how much evidence can be gathered and whether the other side accepts responsibility for what happened to you.
If you enter a no win no fee agreement and your lawyer isn't successful in securing compensation, you won’t pay them a penny. But keep in mind that your solicitors will do a detailed assessment of your case at the outset and will not waste your time if they don’t think the claim has a reasonable chance of winning. Basically, If we take on your case, we are confident in the team's ability to win your case!
You will only pay legal fees if you are successful. The party responsible may have to contribute towards your legal costs and your accident solicitor will make deductions for any unrecovered costs as well as a success fee for winning your case, if applicable. Rest assured though this amount will be agreed with your solicitor beforehand. The amount could include any success fee to be paid to your solicitor, as well as any insurance you’ve taken out to make your claim risk-free.
Any deduction made from your compensation will be discussed and agreed upon with you before you start, so there will be no shocks.
We usually recommend that insurance is put in place to ensure your claim is completely risk-free. An ‘After the Event’ insurance policy should give you this peace of mind.
This covers expenses paid out on your behalf, including expert reports, barristers’ fees and court fees. If you lose your case, your insurance takes care of these charges, so you don’t have to.
The important thing to note is that we organise all this for you and there are no upfront costs for this cover. The insurance premium is only paid if you win your claim and the costs of this are included in our overall cap on charges, so there really are no surprises.
The vast majority of claims, be they personal injury cases or medical negligence, are settled without going to court. However, you may need to appear in front of a judge if the other side does not accept fault.
We will stay by your side throughout the process, and your solicitor will handle all legal proceedings while keeping you in the loop at all times.
If your case fails for any reason and you are not compensated for what happened to you, we won't take a single penny from you as part of a no win no fee agreement.
If you’ve been hurt in an accident in the last three years and someone else was to blame, we believe that you have the right to legal representation. A no win no fee arrangement means we can offer this service regardless of your personal or financial situation.
If your accident injury solicitor agrees to take your case on, that’s a sign that they’re confident of winning. There’ll be no upfront costs and you’ll only pay if you are successful. In the unlikely event of your case losing, there will be absolutely nothing to pay.
You can make an accident claim for someone else, too. If their injuries mean they're incapable of doing so for themselves, you can get in touch with us on their behalf.
Once we've confirmed you have a case for accident compensation, your claim will follow these steps:
- Your accident solicitor will get a picture of how the injury has impacted your life. They may need you to provide evidence, such as photographs or medical documents.
- Once they have everything they need, your solicitor will notify the person or organisation who were responsible for causing your injury.
- The other party will either accept they were at fault or contest it. If it’s the latter, your accident solicitor will negotiate on your behalf, keeping you updated at all times.
- If your claim is successful you will receive your compensation. Your lawyer will take a cut as a fee for their services. If you are unsuccessful, there’s nothing for you to pay.
Yes. Our market-leading calculator tool gives you an immediate claim valuation and will also let you know if you can pursue your case entirely online. Other companies use their calculator tool as a way to encourage you to get in touch, but here at the Claims People we're different.
No two accident claims are ever the same, so it’s difficult to provide a simple answer to this question. The amount of compensation you receive will depend on several things, such as the severity of your injury and the effect it has had on your physical, mental and financial wellbeing.
For example, a successful whiplash accident claim may see you receive a few hundred pounds in compensation, whereas a serious break or fracture could mean you’re paid tens of thousands. Any compensation you do receive will be paid by the other party’s insurance company.
We follow the 15th edition of the Judicial College Guidelines for the assessment of damages, as set out by the Ministry of Justice.
