Car accident claim FAQs

Here are a few questions and answers that you might find useful before you get in touch to talk about claiming for car accident compensation.

How many car accidents happen per year in the UK?

Data from the Department for Transport shows there were 64,112 casualties involving cars on Great Britain's roads in 2020. That represents a 52% fall when compared to figures from 2010.

What is a no win no fee car accident claim?

A no win no fee claim means there's nothing for you to pay if your case loses. It's also known as a Conditional Fee Agreement and it acts as a contract between you and your car accident solicitor.

No win no fee arrangements were first brought in to help people who were entitled to compensation but don't want the financial risk. You'll only pay if you win and your solicitor will make sure all the costs of your proceedings are covered.

Am I eligible to make a car crash claim?

If you've been hurt in a car accident in the last three years where someone else was at fault, you may have the right to claim compensation. Our panel of solicitors take most cases on a risk-free, no win no fee basis and can help you regardless of your personal or financial circumstances.

We'll provide a fast claim assessment and, if your solicitor agrees to take your case, you can treat that as a sign that they're confident of winning. There are no upfront fees and you only pay if you win. That money comes out of your car accident compensation and is capped at a pre-agreed level.

You can also claim on behalf of someone else if their car accident injuries are so severe that they are unable to do so for themselves.

How do I start claiming for my car accident injuries?

You can begin your car crash claim in a few different ways:

  • Pick up the phone and speak to one of our advisors on 0800 587 0344. Our lines are open seven days a week until late and we'll provide a fast claim assessment.
  • Fill out our form with a few basic details such as your name and number. We'll call you back at no charge.
  • Use our car accident compensation calculator for an immediate valuation of how much your claim could be worth. From there, you may even be able to proceed with your case online.

How does the claims process work?

Once we've agreed to take on your car accident claim, the process will usually continue as follows:

  1. Your car accident solicitor will listen as you explain how your injuries have affected you. They may ask for evidence, such as witnesses, photographs and medical records.
  2. They'll get in touch with the other party to let them know that you intend on making a claim.
  3. If the other party accepts the blame, your case should be able to reach a swift resolution. If they don't, your solicitor will begin negotiating on your behalf.
  4. If you win your claim, you'll receive your car accident compensation and your solicitor will take a pre-agreed amount of that as their payment. If you lose, you won't owe a penny.

Can I make a car accident claim online?

Yes. Other companies use their car accident compensation calculator purely as a way to encourage you to contact them. But here at ClaimsPeople, we're different. Our tool offers a genuine valuation of how much your claim could be worth, while it also lets you know if you can pursue your case entirely online.

How long will my claim take?

We'll let you know straight away if you have a case and your solicitor will provide end-to-end support so that you don't have to worry about any of the legal proceedings.

It's important to be aware that some car accident claims can take longer to settle than others. The total duration will depend on a number of factors, such as the amount of evidence that needs to be gathered and whether the other person accepts responsibility for what happened.

What is the average compensation for a car accident?

All car crash claims are different, so there's no easy way to offer a straightforward answer to this question. When assessing compensation, we use the 15th edition of the Judicial College Guidelines, which also help to inform our calculator tool.

How much will I pay my solicitor if I win?

If you win your case, the other party may be required to contribute towards your legal costs. Your car accident solicitor will take a pre-agreed amount of your compensation to account for the rest. This could include a success fee and the price of any cover you've taken out to make your claim risk-free.

Any deductions from your compensation will be capped at a level that you agree to, and your solicitor will talk you through everything at the start so there are no nasty surprises once your claim is settled.

Do I need no win no fee insurance?

When you make a car accident claim, we want you to enjoy complete peace of mind. That's why we recommend taking out After the Event (ATE) insurance, which is designed to make the process risk-free. It covers all of the legal costs on your behalf so that even if you lose your case, you won't have to pay.

We will organise this policy for you and there are no upfront costs. The price of the premium is included in our overall cap on charges, so will be taken out of your compensation.

Will my car accident claim go to court?

Most car accident injury claims are settled out of court. However, if the other party refuses to accept the blame for what happened, your claim may have to be decided by a judge. If that is the case, rest assured your solicitor will take care of everything for you and keep you posted throughout.

What if I lose my car crash claim?

In the unlikely event that you are unsuccessful in claiming for car accident compensation, there'll be nothing for you to pay. That's because we take most cases on a no win no fee basis.
