Can I claim online?

You can start your claim online and may be able to complete the entire process that way. Our compensation calculator will tell you how much your claim could be worth and whether you can pursue it completely online through our partners at National Accident Law. 

Other personal injury companies use claim calculators to encourage you to contact them, but there's no such obligation with ClaimsPeople.


How much compensation could I receive? 

There is no easy answer to this question as no two cases are the same. Rest assured your solicitor will do everything they can to get you the compensation you deserve.

  • They'll calculate this based on details such as:
  • The types and severity of your injuries.
  • How your injuries have affected you and your loved ones.
  • Any loss of income as a direct result of your injury, including past and future earnings.

How does an accident claim work?

If we judge that you have a legitimate case, the claims process usually follows these steps:

  1. Your solicitor will investigate how your injury has affected you and begin collecting evidence. This could include photos and medical records. 
  2. Armed with all the necessary details, your solicitor will notify the person or organisation you're claiming against. 
  3. The opposing party will either accept the blame for your injury or contest your claim. If it's the latter, your solicitor will begin negotiating.
  4. If your claim is successful, you'll receive your compensation. Your solicitor will take payment as a pre-agreed percentage of this amount. In the unlikely event that your case loses, you'll have nothing to pay.

Establishing blame is key in how to win a personal injury claim. Cases come down to four key elements:

  • Duty: Did the person or organisation you're claiming against owe you a legal duty of care?
  • Breach: Did they breach that duty through something they did or failed to do?
  • Causation: Did this breach directly cause your injuries?
  • Damages: How should your injury and any associated losses be compensated?

Proving blame can be complicated, but your solicitor will have the expertise required to prove your claim is legitimate. If they agree to take on your case, this is a sign it has a strong chance of winning. 

Certain pieces of evidence can help support your case, such as:

  • Photographs of your injuries and the scene of the accident.
  • Any reports of the incident, such as police or work accident reports.
  • Medical reports relating to your injuries.
  • Witness statements.

Is there a time limit for making a claim?

You'll usually have a time limit of three years from the date your accident occurred, or from the date you became aware of its effects.

How long will my claim take?

  • The nature of your injury.
  • How easy it is to gather evidence.
  • Whether the other party accepts the blame.

Will I need to go to court?

Most claims are settled out of court, so it's unlikely. But if the other party disputes your claim and a negotiation can't be reached, the matter will have to be decided by a judge.
