Serious injury claim FAQs

Below, we've put together some questions and answers that may prove useful to you before you get in touch to talk about your claim.

What is a serious injury?

A serious injury has a significant and lasting impact on the person who suffers it. It will likely have life-changing consequences for them and their loved ones. Unfortunately, serious injuries can happen almost anywhere. They could be caused by:

And they can take many forms. Here's a list of some of the serious injuries we can help you claim compensation for:

What is a no win no fee serious injury claim?

A no win no fee claim means there'll be nothing for you to pay if you lose your case. It's also known as a Conditional Fee Agreement, and it acts as a contract between you and your serious injury lawyer.

These arrangements were first brought in to help people who were entitled to compensation but couldn't afford the financial risk. You'll only pay us if you win, and your lawyer will make sure all the costs of the proceedings are covered by ensuring that there is suitable legal protection insurance in place.

Am I eligible to make a serious injury claim?

If you've suffered a serious personal injury in the last three years and someone else was to blame, you could have the right to claim compensation. Our panel of solicitors take most cases on a risk-free, no win no fee basis and can help you whatever your personal or financial situation.

We'll provide a fast assessment of your claim and if your serious injury solicitor agrees to take it on then you can treat that as a sign of their confidence in a win. There are no upfront fees and you only pay us if your case is successful. That payment comes out of your settlement and is capped at a pre-agreed level.

You can also claim for someone else if their injuries are so severe that they are unable to do so for themselves.

How do I start the serious injury claim process?

You can begin your claim in a few different ways:

  • Pick up the phone and speak to one of our advisors on 0800 587 0344. Our lines are open seven days a week until late and we'll make a fast assessment of your claim.
  • Fill out our form with a few simple details such as your name and number. We'll give you a call back at no charge.

Use our compensation calculator for a genuine valuation of what your claim could be worth. From there, you may even be able to go ahead with your case entirely online

How does the serious injury claim process work?

Once we've agreed to take on your serious injury claim, the process will usually follow these steps:

  1. Your serious injury lawyer will listen to your story, including what happened and how your injuries have affected you. They may ask for evidence such as witnesses, photographs or medical documents.
  2. Your lawyer will get in touch with the other party to let them know that you intend to make a claim for compensation.
  3. If they accept that they were to blame, your case should be able to reach a swift conclusion. If they don't, your lawyer will begin negotiating on your behalf.
  4. If you win your claim, you'll receive your compensation and your lawyer will take a pre-agreed amount as payment for their services. If you lose, you won't pay a thing.

Can I claim online?

Yes. Other companies use their calculator solely as a way to encourage you to contact them. But we're different - our tool offers an estimated valuation of what your claim could be worth. It also lets you know if you can proceed with your case entirely online.

How long will my claim take?

We'll let you know immediately if you have a legitimate case. And your serious injury solicitor will provide end-to-end support, so you don't have to worry about any of the legal processes.

Some serious injury claims can take longer than others. The time it takes will depend on several things, such as the amount of evidence that needs to be gathered and whether the other party accepts the blame for what happened.

What is the average serious injury claim payout?

Every serious injury claim is different, so it's impossible to provide a simple answer to this question. When we're assessing compensation, we use the 15th edition of the Judicial College Guidelines. These also help inform our calculator tool.

How much will I pay my serious injury solicitor?

If you win, the other party may be required to contribute towards your legal costs. Your serious injury solicitor will take a pre-agreed amount of your settlement to account for the rest. This could include a success fee and the price of any insurance taken out to make your claim risk-free.

Any deductions from your compensation will be capped at a level that you agree to. And rest assured your solicitor will discuss all of this with you at the start, so there'll be no nasty surprises.

Do I need no win no fee insurance?

When you make a serious injury claim, we recommend taking out After the Event (ATE) insurance. It's designed to make the process risk-free and give you peace of mind. It covers all the legal fees so that even if you lose your case, you won't be left with a hefty bill.

We will organise this insurance for you and there is nothing to pay upfront. The price is included in our overall cap on charges, so it will be deducted from your settlement.

Will my serious injury claim go to court?

Most serious personal injury claims are settled out of court. However, if the other party denies they were at fault for what happened, the matter may have to be decided by a judge. If that is the case, rest easy knowing your solicitor will take care of all the legal proceedings for you.

What if I lose my claim?

In the unlikely event that your claim is unsuccessful, there'll be nothing for you to pay. We take most cases on a no win no fee basis.
