Farm accident compensation claims FAQs

We know you probably have questions you want answers to, so we've compiled a list of FAQs below to help you.

How many farm accidents happen per year?

Data from the Health and Safety Executive (HSE) reveals that around 12,000 workers in the agricultural, forestry and fishing industry sustain non-fatal accidents every year.

And further HSE figures show that agriculture has the worst rate of worker fatal injury of all the main industry sectors in the UK.

What kind of farm accident can I claim for?

There are several types of farm injury that you could claim for. Some of the most common types include:

  • Slips, trips or falls on the same level
  • Falls from a height
  • Injury while handling, lifting or carrying objects
  • Making contact with moving machinery

This is not an exhaustive list of all the possible injuries, so don't worry if you don't see yours here. We may still be able to help you claim compensation.

What is a no win no fee farm accident claim?

We take on most cases on a no win no fee basis (also known as a “conditional fee agreement”), and this includes farm accident compensation claims. You will only pay a fee if you win your claim, so you have peace of mind.

This type of agreement was set up to help people who are entitled to compensation but would not normally be able to afford legal representation.

Am I eligible to make a claim for a farm accident injury?

If you've suffered an injury while working on a farm - whether that's an accident with equipment, an impact from falling objects or something else - you could be eligible to claim.

Based on your initial conversation with us, we'll make an assessment and if we agree to take on your case, that's a sign we're confident of its success. You may also be able to claim on behalf of someone else if their injury is so serious that they cannot do it for themselves.

What are the steps to claim compensation?

There are three ways that you can start your farm accident claim:

  • Call one of our friendly advisors for a free initial chat on 0800 587 0344. Our lines are open seven days a week (including Bank Holidays) and we'll let you know straight away if we think you have the potential for a successful case.
  • Fill out our quick, simple online form with your name, number and some details about your injury. We'll call you back at no extra cost to you.
  • Use our compensation calculator and get an instant valuation. This can help you if you want to pursue your case entirely online.

How does the claims process work?

If we decide there is a strong chance you could claim successfully, the process will follow four simple steps:

  1. Your farm accident lawyer will listen to your story. They might ask for supporting evidence such as photographs, medical records and the contact details of any witnesses.
  2. Once they have everything they need, they will contact the other party and inform them of your intention to make a claim.
  3. The other party will either accept the blame or contest it. If they don't accept blame, your lawyer will start making negotiations on your behalf.
  4. If you win your claim, you will get your compensation and your farm accident lawyer will take the pre-agreed percentage as payment. If you lose, there will be nothing for you to pay.

Can I make a farm injury claim online?

Yes, if you use our compensation calculator tool it will let you know if you are able to continue making a claim online.

We're different from other personal injury companies because our calculator isn't designed simply to make you contact us. It will give you an immediate idea of how much compensation you could claim for your farm accident.

How long will my claim take?

No two cases are ever the same, which makes it hard for us to estimate an exact timeframe. Several factors play into the amount of time the claims process might take, including the severity of the injury and whether the other party accepts responsibility for what happened to you.

But, you can rest assured that we'll let you know straight away if we think you have a strong case.

How much compensation could I receive?

All farm accident compensation claims are different. The size of settlement you receive will depend on the scale of your injuries and the impact they have had on your life, among other things. We use the latest edition of the Judicial College Guidelines when making our assessments and these help to inform our calculator tool.

Do I need no win no fee insurance?

We would recommend you take out After the Event insurance so that making a claim is totally risk-free for you. This policy helps to cover the legal fees you may otherwise have to pay the other side if you lose.

Your farm accident lawyer will be able to organise this for you and it won't incur any upfront costs. All you will need to do is pay for the cover if you win, and this will be taken out of the compensation you receive.

Will my claim go to court?

Usually, farm injury claims are settled without needing to go to court. If your case does go that far, your solicitor will look after all the legal proceedings and ensure you are kept fully updated along the way.

What if I lose my farm accident claim?

In the event that your claim is unsuccessful, there'll be nothing for you to pay because we take most cases on a no win no fee basis.
