What is a no win no fee claim and how does it work?

Claiming on a no win no fee basis means there's nothing for you to pay if you lose. No win no fee claims are also known as Conditional Fee Agreements and they act as a contract between you and your solicitor.

How does the claims process work?

Once we've agreed to take on your claim, the process will typically follow these steps:

1. Your solicitor will listen to what happened to gain an understanding of how your injuries have affected you. They may ask you to provide evidence to support your claim. This could include details of witnesses, photographs and medical documents.
2. They will then get in touch with the responsible party to let them know that you intend to make a claim.
3. If they accept the blame for what happened, your claim should be able to move along smoothly towards a conclusion. If they don't, your solicitor will begin negotiations on your behalf.
4. If you are successful in claiming compensation, your solicitor will take a percentage of that settlement as their payment. If you are unsuccessful, you won't owe a penny - that's the advantage of no win no fee

How much will I pay my solicitor if I win?

If you win your case, the other party may be required to contribute towards your legal costs. This is unlikely to cover the full amount, and your solicitor will receive a percentage of your no win no fee compensation to account for the remainder. This could also include a success fee and the price of any insurance you have taken out to make your claim risk-free.

Rest assured that any deductions made from your settlement figure will be capped at a pre-agreed level. Your solicitor will talk through all of this with you at the start, so there will be no unwelcome surprises.

Do I need to take out no win no fee insurance?

We recommend protecting yourself with After the Event (ATE) insurance. It's a policy designed to make your no win no fee claim truly risk-free. It covers all your legal costs so that, even if you lose, there won't be anything to pay.

We'll organise the insurance for you and there won't be any upfront fees. The premium will only be paid if you win your case, at which point it will simply be taken out of your compensation figure as part of our overall cap on charges.

Is my claim likely to go to court?

Most no win no fee personal injury claims are settled without seeing a courtroom. However, if the other party refuses to accept the blame for what happened, yours may have to be decided in front of a judge.
